February 1659

Inquisition taken on the 9th February 1659, before the Mayor, Bayliffs and Steward who sat at the last Court Leet.

1. That the Supvizors shall repaire the Cawsey and cart way that is in decay in Ribleton Lane, and set stoopes in place convenient as also the highway to Swillbrooke, wch is in such decay yt neither Cart or Loaden horses can passe but are in danger to bee over throwne, as also the Cartway and Cawesall in Broad Gate.

2. That the Bailiffs shall cause the Bridge by the water syde by the Broad Gate end staked and Wynded and repaire ffishergate Barrs, and also to repaire the rampers at Gr North Moor yate to keepe the Water in its Course, and to cause the Gripps and watercourses opened about the Syke Trough upon the Spitle Mosse.

3. That the Bailiffs shall repaire the Two Cawles wch. is made upon the Marsh, and [we] doe desire that Mr Maior and his Councell wold ordr. two more to bee made neare unto the Place where the old Milne stood, or where it may bee thought most convenient, haveinge found by experience the benifitt of the said Cawles.

4. That upon the oathes of ten old men there is a Comon footepath and Highway from Rible Bridge downe by Albon Steepe upon a baulke lyinge betweene the Lande late of John Sudell, felt maker, now in the possession of Edward Hindle, and the Lande of Lawrence Bostocke, butcher, in a certain ffield called Water willowe and from the said Albon Steepe upon the said Bawk to the house end of the said Lawrence Bostocke in Cockerhoale wch. said ffotpath and highway was stopt by a staffe and bande hedge by the said Edward Hindle appointmt, to the great prejudice of the Inhitants of this Towne. Therefore the said Edward Hindle shall cause the same [to be] pulled downe before the twenty fift March next, else to pay xxxxs. And if ever hee or any for him shall hereafter Comitt ye same trespasse shall forfeit xli.

5. That Lawrence Bostocke or the Occupoers of the aforesaid house in Corkerhoale shall maintaine and keepe a sufficient style safe for people to passe over with Burthens upon paine of xxs.

6. That the Bayliffs shall cause the Wall by the Goose well raised half a yard higher & to repaire ye Woodworke before ye said Well, as also that they shall cause the stoanes fallen into Minspitt Well taken up and the wall to bee raised at the further end of the said Well and as high as they may judge convenient all alonge the side, also to make woodwork before the said Well as at Goose well.

7. That these psons who accordinge to notice have not paired theire ditches and clensed their Channell in the Tyme limitted vize Raph Sharrocke & Bartholomewe Worthington in the way leadinge to Minspitt well every one of them to pay vjs. viijd. and for every Month thereafter that they shall suffer their Copps to be repaired & their water Course to pay vjs. viiijd.

8. That the water course is Stopped by John Greenwood which comes from Mr Werdens house and Mr John Marsh backside. Therefore wee fynd that by the oathes of sevall Witnesses as also by the i2th prsentment of the Inquest 1650 the Comon and usual Watercourse is and ought to bee through the [undecipherable] formerly by the said presentmt called an Entry & to open the said Water course before the i0th May next else to pay xxxxs.

9. That the ffote Cawsey over the Peele Moore to debdale is in such decay that people cannot conveniently passe to the Marquett and ought to bee repaired by thses psons vizt. Thomas Key, Roger Charnocke, Thomasd Dolphon, Geo: Hodgkinson, Robert Bayliffe and Evan Berley before the xxiij June or evy of them soe offendinge to pay vjs. viijd.

10. That Mr James Hodgkinson hath not scowred his ditch in Newhull Lane accordinge to tyme Given him to the great Prjudice of that way and therefore to pay vjs. viijd.

11. Mr Edmund Werden hasth not scowred his ditch alonge the Crookt acre Mr Seth Mort at his field end in the Broad Gate & Mr James Gorton, accordinge to the tyme limitted therefore to pay vjs. viijd.

12. That these sevall psons shall remove theire middinge wch lye some of them & others within the ffishergate Barrs before the 10th May upon paine of evy of them vjs.viijd. Margarett Addison, Doct Rishton, Raph Eaves, John Marsh, John Place and John Hodgkinson.

13. That these sevrall psons vizt Mr Willm Bannister, Thomas Walmesley de holehouse, Evan Wall, Thomas Sumpner gent, Hugh Copland shall cause theire midding to bee removed wch lye upon ye Towne wast at fryergate end but ye 10th May next, else to pay evy one of them vjs. viijd.

14. Elizabeth Jenkinson, Willm Harrison, John Smythe, Mr Willm Bannester hath not scowred their ditches in Salter Lane accordinge to tyme limitted therefore to pay iijs. iiijd.

15. Thomas ffoole, James Hodgkinson gent, Robert Clarkson, Edward Dawson, Wm Cottam, Mr Wm Wall, Wm Patten gent, Edward Rigby Esq. Mrs Joan Wall, Mr Richard Sumpner, Ellis Wakefield, John Townend and Raph Woodhouse, shall remove their Middinge in St Johns weend before the i0th May next else to pay vjs. viijd.

16. That Wm Curteous (Curtis) shall lay a platt & scowre his ditch at the West syde of Mr Prestons great ??? acre , before the 10th May next else to pay vjs. viijd.

17. That John Key hath made an Inchroachment upon the Townes wast five yards in Breadth & three yards in length therefore left to the discression of Mr Maior and Councell.

18. That Richard Mason hath not scowred his ditch at the South end of his Croft upon Avenham abuttinge upon the land of Mr Maior accordinge to tyme limitted therefore to pay vjs. viijd.

19. Mr Edmund Werden hath not scowred his ditch all alonge the West syde of Roaper feilds accordinge to tyme Given, to the prjudice of the highway in the broadgate therefore to pay vjs. viid.

20. That whereas Willm Loxam was prsented to remove the Sand and Rubbish wch. hee cat in the Back Lane between Margrett Walmsley widd. her Barne at the Lower Stile in Tenter hey and also in St Johns Weend and had tyme given him and also was limitted to remove the same before the 15th May last and being Summoned to pform the said prsentment upon penalty of 40s wee fynd that hee shall remove the same before the xxiiijth of June next, else to forfeit for evy Month 10s a Month.
