Presentments : —

1. Thomas Martin, Alderman, continues Layinge his Middin behinde the ffriergate barrs, before a croft in ye possession of George Woodhouse, contrary to severall presentments made by ye Jury Leet & as apears by the third prsentment of the Last Leet therefore to pay for the time past accordinge to ye said prsentmt vis. viijd. And if he Continue soe doeinge to forffeit and pay for every offence the like penalty of vis. viijd.

2. The Late Balliffes of this towne (Thomas Hodgkinson and John Kellet) did not Repaire the Key wch is on this side the River of Rhible, where the boat Landeth, according to ye Elleavente prsentmt of ye Last Leete, wch shold have beene performed by them before ye twentyninth of September last, and is as we conceive of Evell Example to Succeedinge Bailliffes; therefore to pay ye ffyne of vis. viijd. Imposed upon them by ye said prsentmt.

3. And for as much as the said Key remaines hitherto unrepaired, occasioned by ye neglect of ye said Thomas Hodgkinson and John Kellet, beinge Repugnant to ye said prsentmt, we doe therefore ffind and prsent ye now prsent Bailiffes yt it is theire dutyes to undertake and see the same in all things well and Sufficiently Amended wth whatsoever is needfull or belonginge unto ye Key afforesaid, and that before ye first day of March next, upon paine to fforfeit ye like sume of vis. viijd.

4. Yt ye Butts upon Spittle mosse are in great Ruine & decay to ye prjudice of Artillery & therefore we find that the said Bailiffes of this towne shall cause the same sufficiently to be repaired before ye twenty ffirst of March next that the Exercise may be more ffrequented.

5. Upon ye 17th order of Mr Prestons Guild these psons followinge to be very unfit & unnecessary members to Inhabit amongst us. Some of those are yt are Stallenged but the most of them are fforreigners & inmates & that they be removed forth of this towne before ye first of Aprill next upon payne of vjs. viijd. a piece & for every month after if not Remooved ye harbourers of them to pay vis. viijd. & this we desire may be put in execucon of every one that makes default herein (vizt)

6. Richard Wingreene beinge an Inmate aforenamed doth keepe Comon Ale house wch we Conceive to be Agreat pruidice to ye ffree burgesses of this Burrough & desire care may be taken thereon for ye prvention theoreof that our Libties & ffreedoms may be maintained.

7. Roger Sudell gent Standeth prsented by Serverall prsentmt of ye former Leets for the want of a yate & a Stile at ye end of his horse milne on Chethams backside for want there of many of ye neighbours gardens are Spoyled wth Swine & is evident by ye ffirst prsentmt of ye Last leet therefore we Amerce him to pay his ffyne for the time past for ye nonpformance of ye same accordinge to ye said prsentmt wch appeares to be xxs Contempt.

8. George Woodhouse for Sufferinge ye walls of his seller Staires to ly downe to ye open street who by many neighbours heretofore have beene in danger to have fallen downe then as Complaint hath beene made therefore that he take Course to Raile up ye said walls for ye prvention of a ffurder danger before ye Seacond of ffebruary next or if omitted to fforfeit for his neglect vjs. viijd.

9. That the Assize of bread and beare is as we Conceive much neglected, although Corne beare soe lowe a rate yet nothinge is done in reliefe thereof, which is Contrary to ye Statute in yt case made & provided. And that ye officers ellected For that purpose may be Enquired of & Instructed by Mr. Maior.

10. That at this great Cort Leete holden theise severall prsons ffollowing were Ellected to theise severall offices hereaffornamed (to witt) Thomas Wallmesley ye younger & Richard Osbaldeston viewers ffor fflesh & ffish, Willm Wiggans & Thomas Dolphin Alefounders, & Lawrence Cooke & John Cooborne pinders & herdsmen, likewise Willm Bannester gent & Thomas Dewhurst, Willm Wall & John Kellet groc for Afferers & Assessors & as yet have not taken theire oaths accordinge to ye Custome of this towne wch is against ye welfare of it we therefore desire Mr Maior as Speedily as may be to adresse those things & cause all & every the said psons to come & take theire respective oaths yt further duties they may discharge & yt ye towne hereafter may recieve noe ffurther prjudice as fformerly it hath done by ye neglect thereof.

11. Yt ye prsentmt of the two last Leets togeather wth ye last Inquest of office hath not beene affeared wth being sleigted? as we doe thinke tends to ye great damage & losse of this corporacon by reason yt ye ffines to ye sevrall prsentmts to them prscribed cannot be levied ffor want therof therefore we prsent Mr Willm Bannester ye then Maior of this towne for his neglect in due execucon of his office in not delivering and administring unto Thomas Wearden ye elder, John Sumpner, Edward Taylor & Richard Turner who were elected afferors fo[r] ye yeare of Maior and? theire sevral oathes accordinge to ye accustomed manner of this town for affearinge; wch if he had sworne? them wo[u]ld have beene at ye & an oblicacon upon them that ye things left undone might have been done, wee doe therefore ffine him for his offence therein in ye sum of five pounds.

12. James Townend of this towne being twice sentente by this Jury did both times obstinately deney to sell Ale or beare Contrary to ye gt Statute & made in ye first of Kinge James as ye messenger saith did speake most reproachfully & Contemptible words against ye said Jury wch we hope Mr Maior will not allow but punish him accordinge to ye nature of his offence & ____ thereof wee finde him in 20s, agreeable wth ye Said Statute.

13. James Chambers for making an assault & affray on ye body of John Sharpe therefore to pay iijs. iiijd.

14. John Anderton for makeinge a Tusle & affray upon ye body of John Cowborne & therefore to pay 2s vjd.

15. John Cowborne for makeing a tusle & affray upon ye body of John Anderton therefore to pay ijs. vjd.

16. Willm Dobson the same time did make a Tusle & affray upon the body of John Anderton & therefore to pay ijs. vjd.

17. Whereas Informacon is given to us of one John Tomlinson servt to Mr Luke Hodgkinson beinge a ffurreigne Burgesse yt he wth the rest of his family doe now Inhabit wthin this towne & have not yet Compounded wth ye towne & accordinge to ye tenour of the said Order therefore we prsent & say yt he shall Compound accordinge to the said order.

18. Thomas Wright doth usually & ordinarily ffall & cutt downe whinns upon the moore browe, Contrary to the orders of this towne & the same doth expose & sell ffor his owne advantage wthin short time if not prvented will be destroyed soe that the Supvisors cannot gett a whinn to helpe the highway therefore to pay iijs. iiijd. & every time after he shall be knowne to Comit ye like offence to fforfeit the like fine of iijs. iiijd that soe they may be prserved for that use they are Intended.

19. Ellen Wallmsley for that she Contrary to ye 25 order of Mr Prestons Guild hath Entertained & received into her house Margrett the wife of Lawrence Michaell being a fforeigner wch is lately delivered of a sonne wch in time may become burdensome to this towne if not timely removed. We therefore thinke ffit for the ffuture yt ye Maior of this Incorporacon for ye time beinge doe fforthwth grant a warrant against the said Ellne Wallmesley for theire Speedy remooveall yt soe they may not claim a quiet & an interrupted Settlement by ye Space of 40 dayes & thereby become settled by Lawe in the towne & the towne to maintaine them we leave the said order to Mr Maior yt he may take care to put ye same in execucon.

20. Yt ye prsent Balliffes shall se Stoopes & railes at Davill Bridge & upon the March for the prservation fo the Ramp & to prvent ye decay thereof by horses & other cattell wch is a very needfull & necessary thinge & to be done before the seacond of ffebruary next or to pay vjs. viijd.

21. Yt the ffrierweend leadinge towards the house of Correccion betwixt John Barkers house & the house of Thomas Bickerstaffe is Spoyled & filled upp by Thomas Wallmsley the younger that Carrieth his Rubidge & by that meanes if it be nay breach of water or hath made it unpassable therefore we doe prsent that ye said Thomas Wallmesley shall cause soe much thereof to be removed as at the discretion of Thomas Bickerstaffe & shall be ___ ffitt to such place as he shall appoint before the first of January next or the ffine of twenty shillings Charges as a payne upon him on case he shold neglect to doe the same.

22. Willm Werden ye younger hath Incroached at his now buildinge at his Cellar Staires four ffeete in breadth & ffour ffeete & six inces in length & erected Railes four yeards in Length & ffour ffoote in breadth And Erected likewise Railes before his old buildinge 2 yards in Length & one in Breadth therefore to be Rented by Mr Maior & his brethren what they thinke fitt.

23. Henry Graistocke hath Incroached at ye marsh side upon ye townes waste wth an out cast beinge 2 yeards in breadth & 2 yeards & a half in Length therefore to be Rented by Mr Maior & Councell.

24. Upon the 47th prsentmt of the last Inquest Edward Osbaldeston hath Erected & Builded a Smithy upon the waste of the towns Land wthout the privity & consent of ye Maior Balliffes & Burgesses of this Burrough & Contrary to a guild order & that ye same is not as yet Rented therefore doe refferr it to ye discrecon of Mr Maior & ye Councell.

25. Henry Blackhurst accordinge to ye 38 prsentmt of ye said Inquest that made an Incroachmt at his new house in Church street by makeinge a paire of Cellar staires wch are ffour ffeet & 6 inches in breadth & four yeards & 5 inches in length & as hitherto hath not beene rented therefore ye same we reffer to Mr Maior & Company.

26. Yt by many prsentmt of Leets for these many yeares past Seth Mort gen stands prsented under great pennalties ffor Sufferine a barnsted in St Johns weend there to be waste & as Appeares to us by ye 46 prsentmt of ye said last Inquest therefore to pay for the time past accordinge to ye said prsentmt 4 And we leave the same to ye Succeedinge Leete & they take Care & Cause him to Erect a barne whereas fformerly have beene in some convenient time this next Sumer.

27. Widdowe Huson, John Hollme ye younger & Henry Bretherton yt theydoe Constantly make a middinge Steade at theire doors in ye open Street behind the ffriergate barrs to the great Annoyance & shame to ye governmt of this Burrough & therefore the said Middings by them to be Removed before ye first of ffebruary next or otherwayes to be ffurfeit 6s. 8d a piece & shall forbeare to lay any more theire uppon the like paine of 6s. 8d. a piece.

28. Mr Robte Hesketh Layes his dunge in a Laine Leadinge to Avenam wch is a hinderance unto those yt have an occacon to use ye way yt they can have noe ready passage by reason of ye Incumbrance thereof thereforeto forbeare layinge any more there upon paine to fforfeit & loose ye sume of vjs. viijd.

29. Theise prsons followinge as we thinke beinge Inhabitant Burgesses & of twenty one years of Age & upwards as yet have not taken the oath of A Burgesse to be sumoned at Mr Maiors app(o)intmt to appeare & be sworne before him Accordinge to ye Custome of this towne & as many as refuse to take theise oath to pay vjs. viijd.

30. Yt there are many Inhabitants wthin this towne yt doe Comonly sweepe Myre from before theire doores & houses & there spaces? or if an heapes to ye great Annoyance of this towne for ye prvention whereof we desire Mr Maior doth give notice by the Sexton to all ye Inhabitants wthin this towne yt they shall not sweepe nor suffer ye dunge to be swept into ye Channell or they suffer it to Lye upon theire Causals above 3 days upon paine of vs.

31. Edward Rigby Esq yt Layes his worthinge at ye east end of this towne whereas there has beene many exclamacon? against by many people yt ffrequents this Markett therefore to Remove the same before the 25th of March next or to forffeitt ye fyne of 20s in case of neglect.

32. John Miller of this towne and his wife contry to several orders and prsentmts made against suffringe mens servant sonns and Apprentices to harbour, tipple, and drinke, did in time of divine service sufferr an Apprentice of William Haworths to tipple and drinke in theire house wth other boyes and Apprentices on the Lords day; therefore to pay xxs., and we desire Mr. Maior will take course for the ffuture.

33. Abell Mosse hath Incroached upon ye town wast on Spittle Moss s Swine coate or some such thinge? & to be Rented by Mr Maior & Councell.

34. John Barker hath Incroached at ye end of his ye house by settinge a paire of Staires upon ye waste of the towne therefore to be Rented by Mr Maior & Company.

35. Ye now Balliffes of this towne shall put ye fframes of the 3 drawells wthin theire towne in good & sufficient repaire & yt before ye 10th day of January next or to pay 6s viijd.

36. Hugh Copland hath erected a paire of staires or Ladder & 3 stones wth all yt supports ye same wthin Incroachmt upon ye townes waste wth by ye fformer prsentmts have not beene founde therefore if the same be not Rented we desire it may.

37. Mr Richard Kinge hath Incroached at his new house in ffishergate streete wth a celler & Railes & a perch and by the former prsentmt we cannot finde any were yt he stands prsented for the same & therefore we doe ??? & that ye same is not Rented wch if it be not we desire it may be as soone as possible yt ye revenues ??? to this towne may be noe longer fforgotten.

38. There is a Comon ffrequentinge of divers people in the ffriergate, at higher draw well, every Sabboth day, in the morninge, and that for the space of 2 howers of the same day yt [they] gett and drawe water, wch is a violation to the Sabboth, and if they soe Continue this towne will be evill spoken of, yt ye governmt thereof is not better had in regard; we therefore, to prvent this Inconveniencie, thinke it ffitt yt Mr. Maior wold Informe the sexton to give notice forthwith to all ye inhitants wthin this towne yt they shall forbeare to gett or carry any water upon ye Lords day, upon paine to forfeite every one soe, after notice of offendinge, vis. viijd., yt soe the good and wholesome lawes dependinge thereunto may not be soe wilfully frustrated and that Mr. Maior shall cause this order to be observed, els to be ffinde at ye discrecon of ye first Leete after he is discharged of his office.

39. Yt John Marsh, John Place & Edward Taylor doth Comonly make middin steads in the ffishergate wch is a most undecent thinge & many there are yr make Comp(ain)ts against them by reason they occacon stumlinge of people benighted therefore wee finde that the owners of every such Middings shall cause the same Removed before the first of March next or otherwayes every one soe neglectinge to pay vjs. viijd. a piece.

40. Yt ye late Maior of this towne together wth ye Aldermen & Comon Councell have not as yet accompted for ye proffitts of ye Last Guild Merchant have holden for wch they were Entrusted wch makes the ffree Burgesses of this Burrough rest dissatisfyed wch is Repugnant to the last prsentmt of ye Last Leete yt ye 2 prcedent prsentmts to this have not beene Executed & pformed wch we desire all may for ye satisfaccon of all.
